Guardianship and Alternatives: Protection and Empowerment

John Deangelis

Last week, Senator Bob Casey held a hearing entitled, “Guardianship and Alternatives: Protection and Empowerment”. Guardianship is a legal mechanism which can transfer all of a person’s decision-making power to someone else. More than 1.3 million people with disabilities and older adults are in guardianship arrangements.

During the hearing, Senator Casey introduced his new Guardianship Bill of Rights Act, which will add safeguards to protect the rights of people in guardianship arrangements. This Act will ensure that the civil rights of older Americans and people with disabilities are protected and that their decision-making power is upheld as much as possible.
